چکیده
حقوق مالکانه حوزه گسترده اي دارد که شناسایی و حمایت و احترام به این حقوق همیشه دغدغه حقوق دانان بوده است. نمونه اعلاي این حقوق همان حق مالکیت اشخاص است. حق مالکیت نیز داراي ابعاد گوناگونی است که بعنوان یک حق کامل و مطلق در سوابق تاریخی و فقهی احترام داشته و درکتاب هاي فقهی این حق در برابر هر گونه تجاوز از سوي افراد دیگر تضمین شده است، در نظام هاي تاریخی گذشته، شاهان و وابستگان آنان خود را صاحب اختیار کشور می دانستند و مصادره و سلب مالکیت از اشخاص رایج بوده است. از این رو اسناد تاریخی حقوق بشر در مقام دفاع از حقوق مردم در برابر دولت ها برآمده اند، مانند اعلامیه حقوق بشر و شهروند که در 6 اوت 1789 در مجلس ملی فرانسه به تصویب رسید که حق آزادي، حق مالکیت، امنیت و ایستادگی در برابر ستمگري را از حقوق ذاتی هر انسان دانسته است.
Abstract
Property
rights have a wide scope the recognition and support of which has been always a
real concern of the lawyers. The best example of these rights is the personal
property right.The property right itself has various aspects which is of
respect in historical and religious background as a complete and utter right
guaranteed against all external violations in legal books. In the old political
systems the king and his relatives considered themselves as the ultimate authority and confiscation and expropriation of the people used to be common.
Thus the human right historical records have emerged to defend people’s right
against the governments among which include the declaration of the rights men
and citizens adopted in August 6, 1789 in the French National Assembly which
recognizes the right to liberty, property, security and resistance against
oppression inherent rights of all human kind.
